Nevada Revised Statute 202.210: Publishing Advertisements Containing Prohibited Matter

The Nevada law that prohibits the publication of an advertisement related to products and services that cause a miscarriage can be found in Nevada Revised Statute section 202.210. This statute criminalizes the offense of publishing any advertisement that contains prohibited matter.

According to the relevant law, proprietors of any newspaper or managers of any newspaper, periodical, or other printed work in Nevada, could be held responsible if they permit their printed work to be published with advertisements that are prohibited under N.R.S. 202.200.

N.R.S. 202.200 makes advertisements unlawful if the advertisements provide information on any medicine, nostrum, drug, substance, instrument, or device that is designed to produce a miscarriage or that is designed to cause the premature delivery of a child. N.R.S. 202.200 also makes it illegal to advertise any substance that purports to cause a miscarriage or premature delivery, even if the substance does not actually cause these results to occur. Finally, N.R.S. 202.200 also prohibits anyone to advertise services, aid, or assistance (provided either by the advertiser or another person) to cause a miscarriage or to cause premature delivery.

The person who actually submits an unlawful advertisement under N.R.S. 202.200 can be convicted of a gross misdemeanor offense if the prosecutor can prove he or she improperly advertised substances or services that purport to cause miscarriage or pre-term delivery. The proprietor or manager who allows such an advertisement to be published and who is prosecuted under N.R.S. 202.210 can be found guilty of a misdemeanor offense if convicted. While gross misdemeanors result in more serious penalties than misdemeanors, being convicted of a misdemeanor can still result in possible jail time, fines, and a permanent criminal record.
