The Las Vegas community is devastated after a 41-year-old bicyclist was fatally struck by a vehicle on Las Vegas Boulevard. According to initial reports, Abe Cruz Mendibles was on his bicycle and riding on the sidewalk east of the road. Witnesses have not confirmed which direction the 41-year-old was going, but it’s apparent that a vehicle went up and over the curb before hitting the bicyclist.
The vehicle, according to a couple who was driving down the road, reportedly came up very fast behind them before veering suddenly to the left.
When that happened, the car rotated around, flew past all three travel lanes, and then went up onto the curb. Not only was the bicyclist struck, but the car also hit a power pole, which may have increased the damages sustained by the victim. The crash was reportedly so severe that the bicyclist’s legs were nearly entirely severed, and he was tragically declared deceased at the scene.
The driver of the vehicle was immediately taken into custody and charged with DUI resulting in death and driving with a suspended license.
Getting convicted of driving under the influence resulting in bodily harm or death is a very serious ordeal. In Las Vegas, this crime is considered a felony offense even if the individual has never been arrested for any other crime in the past. What’s more, this crime is considered a category “B” felony, which is the most severe type of felony under Nevada law.
If convicted, then you could face a maximum of up to 20 years in Nevada prison. The best-case scenario would be getting sentenced to a minimum of 2 years. Aside from that, you’ll also get hit with heavy fines that range between $2,000 and $5,000.
A felony conviction also has life-altering implications. You’ll immediately lose certain rights even once you’ve served out your sentence. That includes losing the right to vote in public elections, losing the right to own or possess a firearm, and you’ll never be able to serve on a jury again. These civil rights may not mean much to you now, but once you lose them, it’s very difficult to ever regain them again. A felony conviction might also exclude you from certain employment opportunities, especially ones that involve driving duties.
The number one way to avoid enduring the consequences associated with a DUI resulting in death or substantial bodily harm is to hire a good DUI defense lawyer to represent you. The right attorney will not only help you understand your charges and potential penalties, but they’ll also help you come up with a good legal strategy to avoid the worst consequences.
